No data protection officer has been appointed; the conditions of § 38 Abs. 1 BDSG are not met (there are not at least 20 persons constantly engaged in the automated processing of personal data).

2. The essentials in brief

• On a first visit without a stored opt-out, this website loads Google Analytics 4 when the page opens and may set analytics cookies before you make a choice in the notice.
• Choosing “Decline” stops further measurement events. The stored decision “denied” prevents Google Analytics from loading on later page views; the initial page view already sent cannot be withdrawn.
• All images and films are delivered from our own server. We do not use external fonts, maps or video platforms.
• We process personal data through the contact form, in technically necessary server logs and – for as long as no opt-out is stored – through Google Analytics 4.
• Transmission is encrypted (TLS/HTTPS).

3. Hosting and server log files

This website is hosted with an external service provider: Namecheap, Inc., 4600 East Washington Street, Suite 300, Phoenix, AZ 85034, USA. When the website is accessed, the server automatically processes information transmitted by your browser: the page accessed, the date and time of access, the volume of data transferred, the browser type and version, the operating system, the previously visited page (referrer) and the IP address. This data is not merged with other data sources.

The processing takes place on the basis of Art. 6 Abs. 1 lit. f DSGVO (GDPR). Our legitimate interest lies in the secure, stable and error-free provision of the website. The log data is deleted automatically after 14 days at the latest. If, in an individual case, it is needed to investigate a specific attack or malfunction, the entries concerned are retained until the investigation has been completed and are deleted thereafter. The hosting provider processes this data exclusively on our behalf on the basis of a data processing agreement pursuant to Art. 28 DSGVO.

4. Contact form and contact by email

If you write to us via the contact form, we process the details you enter: your name, your email address, optionally your company, and the content of your message. The message is transmitted by email to our mailbox icerobot@ai85.org; in the course of this it is carried via our provider’s email service and stored in our mailbox. It is not stored in a database on the website.

The legal basis is Art. 6 Abs. 1 lit. b DSGVO insofar as your enquiry is directed at the conclusion or the initiation of a contract, and otherwise Art. 6 Abs. 1 lit. f DSGVO (our legitimate interest in answering enquiries). We use your data exclusively in order to deal with your enquiry and do not pass it on to third parties.

We keep your enquiry and our reply for as long as is necessary in order to deal with it. If the correspondence becomes business correspondence, it is subject to the retention periods under commercial and tax law (§ 257 HGB, § 147 AO); it is deleted thereafter.

To protect against misuse, the form contains a field that is invisible to humans (a honeypot) and a limit on how often it may be sent. For this purpose the time of a send attempt is held, together with the IP address, exclusively in the working memory of the server and is deleted automatically ten minutes after the last send attempt at the latest; it is not stored on any storage medium (Art. 6 Abs. 1 lit. f DSGVO – protection against automated mass enquiries). If you write to us directly by email, the foregoing applies accordingly.

Providing your data in the contact form is required neither by law nor by contract. We do, however, need your name and email address in order to be able to answer your enquiry at all; without these details we cannot reply to you. Providing your company is voluntary, and its absence has no consequences.

5. Storage in your browser

Google Analytics may set analytics cookies on the first page view. In addition, the website uses up to two local-storage entries. These entries remain in your browser and are not transmitted to us by local storage itself:

You can delete both entries at any time via the settings of your browser.

• “ai85-motion” – if you reduce motion effects, so that the setting is retained.
• “ai85-consent-analytics” – your decision about further measurement. The entry contains either “granted” or “denied”. When it contains “denied”, Google Analytics is not loaded on subsequent page views. If you delete the entry, your decision is treated as open again and measurement starts again on the next page view.

6. Web analytics with Google Analytics 4 and opt-out

Unless “denied” is already stored, Google Analytics 4 is loaded when the page opens and before you make a choice in the notice. Google Analytics 4 is a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. An initial page view is transmitted and Google may set analytics cookies. Choosing “Decline” stops further measurement events; the initial page view already transmitted cannot be withdrawn.

Purpose: we want to understand which sections of this page are read and which search terms lead visitors here, so that we can improve the page. For processing carried out before your opt-out, we rely on our legitimate interest in reach and usage analysis under Art. 6 Abs. 1 lit. f DSGVO. If you choose “Accept”, subsequent processing is based on your consent under Art. 6 Abs. 1 lit. a DSGVO. This does not replace the prior consent generally required by § 25 Abs. 1 TDDDG for storing or accessing non-essential cookies; in this configuration, the initial page view is transmitted and analytics cookies are set before your choice.

Data processed: pages accessed and time spent, approximate location at country or region level, device type, browser and operating system, and the referring page. Your IP address is truncated by Google before it is stored (IP anonymisation). In the course of this, Google sets cookies which recognise your browser.

No advertising takes place. The consent you give applies only to measurement: personalised advertising, advertising cookies and the passing on of data for advertising purposes are permanently deactivated in our configuration.

Transfer to the USA: Google may also process the data collected in the United States. Google LLC is certified under the EU-US Data Privacy Framework (adequacy decision of the European Commission of 10 July 2023); in addition, the Standard Contractual Clauses apply. We point out that US authorities may, under certain conditions, access data.

Storage period: the usage data collected by Google Analytics is deleted automatically after 14 months.

Opt-out and withdrawal: choose “Decline” in the notice. Further measurement events stop immediately, “denied” is stored in local storage, and Google Analytics is not loaded on later page views. The initial page view already transmitted cannot be withdrawn. If you previously chose “Accept”, delete this website’s data in your browser and choose “Decline” when the notice reappears; however, the initial page view of that new visit will already have been transmitted before the notice appears.

7. Recipients and transfer to third countries

Recipients of your data are our hosting provider, our email provider and, for web analytics, Google Ireland Limited as the provider of Google Analytics 4. Where these providers act on our behalf, processing is governed by a contract under Art. 28 DSGVO. Your data is not passed on for other purposes or to any other third parties.

The website is operated in a data centre in Amsterdam, Netherlands (EU); your personal data is therefore processed and stored within the European Union. No regular transfer to a third country takes place.

The operator of this data centre is Namecheap, Inc., a company established in the United States. Access by the US parent company to the data stored in the EU can therefore not be entirely ruled out. For that case, appropriate safeguards exist in the Standard Contractual Clauses adopted by the European Commission (Durchführungsbeschluss (EU) 2021/914), which form part of the data processing agreement concluded with the provider (Art. 46 Abs. 2 lit. c DSGVO). 8. Your rights

You have the following rights against us in respect of the data concerning you:

On this website that concerns the server log files, the misuse protection of the contact form and the answering of enquiries, insofar as this does not serve the initiation of a contract. If you lodge an objection, we will no longer process the data concerned, unless we can demonstrate compelling legitimate grounds which override your interests, rights and freedoms, or the processing serves the assertion, exercise or defence of legal claims.
